Position: Staff Attorney - Day Laborer

Description: A CASA of Maryland staff attorney is on the front line in defending immigrant workers against abuse by landlords, employers, the police and immigration officials. This is an excellent opportunity to build your legal skills, build power in the immigrant community, make a lasting difference in the state of Maryland and to work with a dynamic group of paralegals, lawyers, organizers and social service staff in a friendly, fast-paced, multi-lingual and multi-cultural office. This position will focus on day laborers and their legal needs and on developing creative legal and non-legal strategies for combating abuse of day laborers and other low-wage immigrant workers. (Part time schedules considered)

Duties/Responsibilities:

Develop & Implement Day Laborer Legal Strategy

  • Work closely with day labor organizers, employment specialists and workers’ committees to identify abusive employers and problematic workplace trends and develop strategies—legal and non-legal—to address these issues.
  • While the issue of non-payment of wages has typically guided the work of the legal program’s workers’ rights work, this position may evolve to address additional needs that the workers’ committees identify as their priorities.
  • Develop impact litigation, along with pro-bono or reduced fee counsel, to combat injustice against day laborers on issues related to wage theft, working conditions or other issues of concern to day laborers. 

Policy Work

  • Supports CASA’s legislative and policy work related to workers’ rights.  The following are examples of potential activities:
    • Campaign to improve the capacity and effectiveness of Maryland’s Dept. of Labor, Licensing, and Regulation, which enforces Maryland’s wage and hour laws.
    • Identify annual legislative priority surrounding workers’ rights and, in conjunction with CASA leadership, develop and implement plan to move it forward.
    • Respond to local ordinances which adversely affect workers (e.g. the City of Gaithersburg passed an anti-solicitation law that adversely affected day laborers and was declared unconstitutional by the Attorney General of Maryland).

Direct Legal Work

  • Oversee and participate in legal intakes and case work regarding wage theft and other work-related issues such as workplace injury.
  • Provide referrals, brief legal services, negotiate, and occasionally litigate individual cases of workers who meet established criteria, usually under the federal Fair Labor Standards Act, Maryland Wage Payment and Collection Act, and the Maryland minimum wage and overtime laws.
  • Develop and implement creative strategies for collection on judgments. 

Outreach/Popular Education 

  • Oversee educational “know your rights” presentations, including identifying emerging areas that merit presentations, developing educational presentations and curriculum, giving presentations to workers and community members, and supervising legal assistants giving non-legal presentations
  • Engage in education and outreach through “know your rights” presentations, dissemination of materials and “training of trainers” workshops in which organizers and workers are trained to reach out to others to inform them of their rights

Administrative Work: Complete monthly reports on activities (very light burden). And other duties assigned by supervisor related to position. 

Qualifications/Skills: Understanding of and commitment to using the law as part of a multi-faceted, community-based approach to social change. Creativity and willingness to be a lawyer who says “yes”. Bilingual (English and Spanish). Applicants with strong Spanish skills who are willing to take specific steps to develop functional fluency can be accommodated. Ability to speak French is helpful as more and more French-speaking immigrants are visiting CASA’s centers. J.D. and admittance to Maryland Bar or willingness to sit for Maryland Bar exam (less intensive, 1/2 day out of state attorney exam available for those with five years’ practice experience). Knowledge of federal or state wage and hour. Excellent written and oral communication skills. Ability to work independently and as part of a team. Highly organized and able to manage multiple ongoing projects. Two or more years’ post-J.D. experience preferred. Exceptional third year law students with direct experience with immigrants and demonstrated commitment to immigrants’ rights will be considered. Ability to work flexible hours including evenings and weekends. Because of the need to be onsite at CASA’s various centers (e.g. Wheaton, Shady Grove), and the limited availability of public transportation, a car is required for this position. CASA provides mileage reimbursement at the IRS-recommended rate, currently $0.505 per mile, to cover the cost of ownership, maintenance and gasoline.

Salary/Benefits: $40,000 to $48,000 plus generous benefits, including 403b retirement plan with employer contributions, personal leave, bar dues reimbursement and mileage reimbursement, 4 weeks paid parental leave (after 9 months of employment), 1 week paid family leave for serious illness or death of a close relative, including a domestic partner. Seven days compensatory time, in addition to three weeks paid vacation, is provided for in the collective bargaining agreement, in recognition of the varied hours required of a staff attorney. After two years, paid vacation increases to four weeks. Part-time schedules, with commensurate salaries and benefits will be considered. September start dates will also be considered.

Company/Agency: Homeless Persons Representation Project, Inc.

Position: Staff Attorney

Description: The Homeless Persons Representation Project (HPRP), a non-profit legal services and advocacy organization, seeks to hire a full-time attorney to work in its access to housing and employment project. For a number of years, this project has attempted to eliminate barriers to housing and employment posed by criminal records. In particular, the work has focused in the areas of representing families and individuals in administrative and court hearings to obtain or prevent termination of shelter or subsidized housing, assisting individuals in expunging criminal records, negotiating for less stringent criminal record screening policies with the local Housing Authority and other housing providers, and advocating for expansion of eligibility under Maryland’s expungement statute. Most recently, HPRP staff has also engaged in advocacy regarding permanent supportive housing for chronically homeless individuals and represented clients in their attempts to access this special housing resource.

Duties/Responsibilities:

Responsibilities include individual representation and policy advocacy, such as:

  • Representing families and individuals in administrative proceedings with Shelter or Transitional Housing Providers, the Housing Authority of Baltimore City, and Private HUD-Assisted Developments;
  • Representing families and individuals in Court eviction proceedings;
  • Representing families and individuals in criminal record expungements;
  • Providing limited supervision of Expungement Legal Assistant;
  • Collaborating with pro bono counsel on housing and expungement matters;
  • Conducting “Know Your Rights” workshops on access to housing and criminal record expungement;
  • Testifying at public hearings, including before the Maryland General Assembly, and supporting clients in the preparation of testimony;
  • Collaborating with other attorneys and community partners on legislative, regulatory, budget and other policy matters relevant to the project area.

Qualifications/Skills: Demonstrated commitment to working with people in poverty; Minimum 3 years litigation experience (two semesters of clinical experience as a law student will be considered equivalent to one year of litigation experience); Admitted to practice law in Maryland, or willing and eligible to sit for the next available Bar exam or Attorney’s Exam; Excellent written and oral skills. Ability to work independently and as part of a team. Housing or criminal litigation experience is a plus, as is fluency in Spanish.

Description: The Legal Services National Technology Assistance Project (NTAP) is a small, nonprofit organization that fights injustice to low-income persons by helping nonprofit legal aid programs implement effective and innovative technologies.  NTAP provides technology assistance, training, leadership, and outreach to more than 150 nonprofit legal aid programs across the country. The Legal Services National Technology Assistance Project (NTAP: http://.lsntap.org) has an opening for a Project Coordinator for Online Training and Tech Library. This position is suitable for a person with a strong interest in making a difference in the social justice community through the effective use of technology.   It is ideal for a candidate dedicated to helping -- public interest lawyers, directors, court personnel, and other legal aid staff – use technology to succeed in their efforts to deliver high quality legal services to low income people and to improve access to justice. Specifically, this person will deliver online training events geared for legal aid staff and generate and manage content on the LSNTAP.Org website related to those events.

This position will coordinate the NTAP's online training program and content on LSNTAP.Org.  The Training Project Coordinator will be responsible for learning about, supporting, and training on a variety of technical related topics that have demonstrated a positive impact on helping legal aid programs succeed (see http://lsntap.org/techlibrary).  This position is responsible for developing the training calendar, delivering one to four webinar trainings per month, developing online content (blogs, articles, and presentations) related to training topics , coordinating presenters and/or presenting training sessions, and ultimately evaluating the training program.  Lastly, this position will build a virtual community – coordinating users and advisory boards of the project to build support, gather ideas, and share best practices.

Duties/Responsibilities:

  • Provide training, technical assistance and informational resources that increase the understanding legal services programs and members of the access to justice community, have about the ways to use of technology can improve services to clients.
  • Identify key technology areas that are relevant to legal aid delivery systems; identify training needs relative to specific audiences and develop appropriate mechanisms to deliver information appropriately.
  • Deliver high quality trainings to various audiences; namely legal aid leaders, attorneys, staff and techies and the broader access to justice community including Bar, IOLTA and Court personnel.  
  • Incorporate adult learning methods into the training program including engaging the audience and reinforcing key concepts.
  • Develop on-line website tech library resources.Develop creative and innovative approaches to cost effective support and promotion.
  •  Maintain, update, and create resource materials, online "how-tos", and marketing materials about using these tools.
  • Coordinate and host regular "Roundtable" calls in order to discuss emerging technology and promote best practices within the field.
  • Coordinate national advisory boards.
  • Participate in fundraising and coordinate sustainability planning for the project.

Position: Victim Therapist – LCSW-C or LGSW

Description/Responsibilities: The Maryland Crime Victims’ Resource Center, Inc. is seeking a dynamic and dedicated individual to fill the role of a full time Therapist. The therapist will work in collaboration with the Victim Services and Legal Services staff to ensure that therapeutic needs of clients are addressed. The therapist is responsible for providing direct mental health services to victims, providing assessments and developing treatment plans for individuals and families. Additionally, he/she is responsible for the development and facilitation of specialized support groups for victims of crime (i.e. adult grief, domestic violence). Description:The Maryland Crime Victims’ Resource Center is seeking a dedicated and dynamic individual to fill the role of a part-time Victim Advocate within its Upper Marlboro Office. Originally the Stephanie Roper Committee and Foundation, MCVRC is one of the most successful grassroots organizations in the history of Maryland. MCVRC has been instrumental in passing more than 70 pieces of state legislation. MCVRC is a leader in providing criminal justice information and education; support services; therapeutic individual, family and group counseling; and legal information, referrals, and representation.

Duties/Responsibilities: Victim advocates provide direct support and non-legal services to victims of crime including, but not limited to: crisis intervention, advocacy, court accompaniment, referral services, follow-up contact, coordinating services within MCVRC, and coordinating with other agencies throughout the state. Other Victim Advocate duties are: accurate record keeping and data entry of client cases and files, representing MCVRC at meetings and events, assistance with grant reporting, event planning/staffing, and other duties as assigned. The Victim Advocate works under the supervision of the Coordinator of Victim Services and in close collaboration with other MCVRC staff to ensure that all victims’ needs are addressed.

Position: Executive Director

Description: The Asian Pacific American Legal Resource Center (APALRC) is a 501 (c)(3) non-profit organization dedicated to advancing the legal and civil rights of Asian Americans in the Washington, D.C. metropolitan community through direct services, legal referrals, education, and advocacy. Through its innovative programs and strategic partnerships, the APALRC's main goals are two-fold: (1) to address the individual legal needs of low-income and limited-English proficient Asian Americans, particularly in the areas of workers’ rights, domestic violence, and immigration, and (2) to advocate for broad-based systemic change on civil rights issues impacting Asian Americans.

The Executive Director will report to a Board of Directors comprised of 16 members and will work with 9 full-time staff in addition to community stakeholders. The Executive Director is charged with the overall vision; the oversight of APALRC’s direct legal services, advocacy, and other programs; the development and implementation of a strategic plan; leading the fundraising process and donor relations; managing all internal operations in partnership with senior staff; assuming leadership roles in community affairs and collaborative initiatives; and serving as the public voice of the organization.

Responsibilities:

  • Provide leadership on a number of collaborative efforts in the legal services, broader immigrant, and Asian American communities in the DC metropolitan region
  • Work collaboratively with staff to oversee APALRC legal services and advocacy programs and to regularly assess and evaluate program impact
  • Lead the organization through a shared leadership model
  • Participate in regular meetings with the Board, executive committee conference calls, and other committee meetings as necessary to report on the status of the organization’s work, particularly on issues of strategic importance
  • Advocate for public funding from local government jurisdictions, cultivate and strengthen relationships with current foundation donors, and provide public officials with ongoing input on funding needs and priorities within the Asian American community and the broader immigrant community
  • Leverage new funding opportunities (national and local, private and public) through relationship-building, networking and increased public visibility
  • Provide management support to senior managers in their supervision of junior staff, including assisting them in the development of performance goals for each junior staff member, setting benchmarks, and conducting regular performance evaluations/reviews
  • Assess key needs of the organization such as facilities and technology infrastructure in partnership with senior staff to promote highest levels of efficiency
  • Develop an annual budget in conjunction with key staff and the Board, including mapping out projected expenses and revenue sources

Position: Director of Banking Operations and IOLTA Compliance

Description: Maryland Legal Services Corporation (MLSC) is a private, nonprofit corporation created by the Maryland General Assembly in 1982 to administer funding to be used for the provision of civil legal services to low-income persons. One of MLSC’s primary funding sources is the Interest On Lawyer Trust Accounts (IOLTA) Program, which requires all Maryland attorneys to place nominal or short-term escrow deposits in IOLTA accounts. Interest from these accounts is remitted to MLSC either monthly or quarterly from approximately 100 Maryland financial institutions, and MLSC uses this and other revenue to provide grants to 38 legal services programs throughout the state. Attorneys are required to report annually on their compliance with the IOLTA Program.

The Director of Banking Operations & IOLTA Compliance reports to the Executive Director. The successful candidate will be responsible for ensuring attorney and financial institution compliance with IOLTA, providing strong management of all aspects of in-house IOLTA operation functions, as well as exercising leadership in fostering MLSC’s banking relationships and enhancing IOLTA revenue.

Responsibilities:

  • Serve as ‘relationship manager’ with financial institutions: develop and implement strategies for strengthening partnerships with banks and building support for IOLTA in the banking community;
  • Oversee and manage systems for IOLTA remittance reporting and annual attorney compliance reporting, ensuring accuracy and integrity of IOLTA data and reports;
  • Initiate the design, development and implementation of any necessary modifications to IOLTA database and other IOLTA computer reports and processes to enhance operations;
  • Supervise staff (IOLTA administrator; data entry assistants, etc) in its handling/recording/tracking of all remittances and routine follow-up with banks where necessary, and manage staff and coordinate with contractors engaged in all IOLTA operations-related functions;
  • Monitor bank compliance with IOLTA rules and regulations;
  • Analyze IOLTA income trends and develop plans and programs to work with financial institutions to increase IOLTA revenue;
  • Develop/Update IOLTA materials, such as brochures, bank recognition materials, web site information, etc.

Qualifications/Skills:

  • Minimum B.A. degree in business or related field;
  • Minimum of five years banking experience, preferably in a project or product management capacity with responsibility for and/or extensive involvement with both retail and commercial deposit products;
  • Excellent analytic skills; financial management and analysis skills highly desirable;
  • Proficiency in database management and ability to oversee information management systems;
